Please read these general terms and conditions carefully: they define the terms and conditions of sale applicable when you place an order on the website www.segura-moto.com

 

DEFINITIONS 

The terms used below in these general terms and conditions of use and sale, both in singular and plural, shall have the following meanings:

Client: any adult natural person, capable of entering into a contract and having the status of consumer within the meaning of the Consumer Code, who orders Products on the Website for non-professional purposes under the conditions defined below.

General Terms of Use and Sale or GTUS: these general terms and conditions applicable between the Seller and the Client, which the Client declares to accept when ordering Products, governing the use of the Website and the sale of Products.

Product: any product offered for sale by the Seller on the Website, including motorcycle helmets and associated visors, as well as telecommunication accessories.

Website: the infrastructure accessible at www.segura-moto.com, owned and operated by the Seller.

Seller: TROPHY, SAS, registered under SIREN number 538081860, recorded under number 538 081 860 at the Versailles Trade and Companies Register, with its registered office located at 1 Avenue Eiffel, 78421, Carrières-sur-Seine, represented by its acting legal representative, Christophe Merkel, who operates the Website and sells the Products.

 

PURPOSE AND APPLICATION OF THE GENERAL TERMS OF USE AND SALE

These General Terms of Use and Sale define the rights and obligations of the Seller and the Client applicable to the use of the Website and the sale of Products, which the Client accepts by ticking the box provided for this purpose when ordering Products.

Any order placed via the Website by the Client requires prior acceptance by the Client of these GTUS as well as the current pricing conditions on the day of order acceptance, which form an integral part thereof.

These GTUS are permanently accessible on the Website, in a digital format allowing printing and/or downloading, so that the Client can reproduce or save them.

The Seller reserves the right to modify the GTUS. The new GTUS will be submitted to the Client prior to any order.

 

ORDERING PRODUCTS

The Products offered on the Website are intended solely for sale to individuals.

Account creation: placing an order requires the Client to create an account, at any time and no later than when placing the order by clicking on the button provided for this purpose.

The Client must complete the form with the requested information. Personal data provided by the Client will be processed in accordance with the privacy policy available on the Website.

The Client undertakes to provide accurate information. The provision of false information by the Client, which prevents the Seller from fulfilling its obligations, including delivering the Products, shall not engage the Seller’s liability as a result.

The account will be accessible using the login credentials (email address and password) chosen by the Client at the time of registration or subsequently modified. The Client acknowledges that these credentials are strictly personal and confidential. Accordingly, the Client is prohibited from sharing them with third parties. For security reasons, the Client is advised to choose a strong password according to applicable standards (8 characters, including uppercase, lowercase, numbers, and special characters). In case of suspected fraudulent use of their credentials, the Client is advised to immediately inform the Seller.

Product selection: to place an order via the Website, the Client must select the Products they wish to purchase by adding them to the shopping cart.

In accordance with Articles L.111-1 et seq. of the French Consumer Code, the characteristics of the Products are detailed on the respective product pages of the Website.

The Client is informed that the shopping cart serves only to list the Products chosen and does not reserve them for other users. Products will only be reserved and pricing updated at the time the order is validated.

Once the Product selection is complete, the Client will finalize their order from the shopping cart.

Ordering Products: the Client will be redirected to the cart containing a summary of the selected Products, the price, and the delivery fees. The Client will have the option to modify Product quantities or remove a Product from the cart. They can finalize their order by clicking the designated button.

Unless already logged in, the Client must create an account or log in if they already have one. The Client must provide their address (delivery and billing address if different), may apply a promo code, choose their delivery method among those offered, and then proceed to payment by clicking the designated button.

The order becomes firm and final only after payment of the price. The Client will receive a confirmation email detailing their order.

The Seller reserves the right to cancel or refuse any order from a Client with whom there is a dispute regarding payment of a previous order.

Product availability: the Seller undertakes to fulfill orders only within the limits of available stock.

If a Product is unavailable, particularly if it becomes unavailable between the order and payment, the Seller will inform the Client as soon as possible, indicating the estimated restocking time. At the Client’s request, the order may be partially canceled for the unavailable Products with a refund.

 

PRICE AND PAYMENT OF THE PRICE

Price: The price of Products displayed on the Website is the current rate and is expressed in euros, including all taxes. In addition to the Product price, delivery fees apply for each order, the amount of which is indicated in the cart and the order summary.

The selling prices of the Products are freely determined by the Seller and may be modified at any time. The applicable price will be the one in effect at the time of the order.

Payment: payment methods are indicated on the Website’s payment page and during the order process. The price can be paid by Credit Card (CB, Visa, Mastercard), American Express, Paypal, Apple Pay.

The price is payable in full at the time of order via the secure space of the institution handling payment on the designated page.

The Client guarantees that they are fully authorized to use the chosen payment method and that they have sufficient funds to cover the order costs. Any bank fees related to credit card payments will be the responsibility of the Client.

 

DELIVERY

Delivery: Products are sold only to Clients whose delivery address is located in one of the following countries: France, Germany, Austria, Belgium, Spain, Ireland, Italy, Luxembourg, Netherlands, Portugal, Bulgaria, Croatia, Denmark, Estonia, Finland, Greece, Hungary, Latvia, Lithuania, Poland, Romania, Slovenia, Czech Republic, Sweden, Slovakia.

Delivery occurs within the timeframe indicated at the time of order, depending on the delivery method and location:

  • Standard home delivery: maximum 3 business days in France and a maximum of 5 days for other EU countries

  • Express delivery: maximum 48 business hours in France and a maximum of 4 days for other EU countries

  • Delivery to pickup point: maximum 3 business days in France and a maximum of 5 days for other EU countries

Any delivery delay beyond the estimated delivery date, not due to force majeure, may result in the contract being rescinded at the Client’s initiative by sending a registered letter with acknowledgment of receipt. In accordance with Article L216-6 of the Consumer Code, the sale will be considered rescinded upon receipt by the Seller of the Client’s letter informing them of their decision to rescind the sale if delivery has not occurred in the meantime. In the event of rescission, the Seller will refund the Client as soon as possible, and at the latest within 14 (fourteen) days from receipt of the registered letter with acknowledgment of receipt.

In case of non-delivery and/or return of the package due to the Client’s fault (e.g., wrong address, failure to collect the package from the post office), the Client will be responsible for the associated costs (storage and/or reshipping fees).

Receipt: If the package delivered by the carrier is in poor condition and Products are missing, the Client is advised to refuse the package and make explicit reservations on the delivery note so that the carrier’s guarantee may apply. The Client must inform the Seller in writing as soon as possible so that the Seller can investigate with the carrier. The Client is reminded that accepting the package without reservation may extinguish the Seller’s claims against the carrier.

 

WITHDRAWAL

In accordance with the provisions of Article L.221-18 of the French Consumer Code, the Client has a period of 30 (thirty) days to exercise their right of withdrawal and return, at their own expense, the Products they ordered for any reason. This period starts from the day the Client receives the Products, the dated delivery note being proof. Withdrawal can be made by the Client by sending a request to the Seller via the online form provided on the Website.

The Client is requested to return the Products in their original packaging, if possible accompanied by the Return Form proving that they are indeed Products purchased via the Website.

The return of the Product(s) will be made to the Seller at the address indicated on the withdrawal form, within thirty (30) days following the date on which the Client exercised their right of withdrawal. The costs and risks related to the return of the Products are borne by the Client.

After receipt and verification of the Products, the Seller will refund the Client the amount of the returned Products within a maximum of 14 (fourteen) days from the receipt of the Products (or proof of shipment by the Client), using the same payment method that the Client used to purchase the Products, unless otherwise agreed in writing between the Client and the Seller.

In the event of depreciation of the Products resulting from handling other than what is necessary to establish the nature and characteristics of the Products, the Seller may request the Client to pay compensation corresponding to this depreciation.
